In addition, often expert and fact witnesses are allowed to present their direct testimony by written sworn witness statements with the witness only appearing for cross-examination and possibly. To understand why written statements meld these two traditions, it is necessary to understand the different methods common law and civil law practitioners have used to present evidence to the finder of fact. Likewise, parties opposing such self-serving statements might consider responding to such correspondence when they have the opportunity to do so. “It is the arbitral tribunal’s duty to ensure that evidence is taken in an efficient and economical manner, while also ensuring, ‘equality of arms’ between parties from vastly different legal traditions.” The benefit of efficiency while blending the traditions of both common law and civil law procedures explains why written witness statements have become favored tools of evidence presentation in international arbitration. Civil and Common Law Differences in Presenting Evidence It concludes with suggestions for procedures to use written witness statements effectively in international arbitration disputes. This chapter explains how written witness statements originated and describes how to use them. Among their many benefits, written witness statements prompt advocates to prepare their cases well in advance of the arbitration hearings, making them better prepared overall. By giving this statement, you become an impartial witness who shall give the legal authority an idea of the defendant’s character while explaining why he may have done the crime. That procedureknown as written witness statementstakes the best from the common law and civil law systems in order to allow parties from different cultural and legal backgrounds to present evidence. On the other hand, a character witness statement may be given to help out a defendant and possibly give him a reduced sentence. That procedure-known as written witness statements-takes the best from the common law and civil law systems in order to allow parties from different cultural and legal backgrounds to present evidence fairly to international arbitral tribunals. Originally from the ICDR Handbook on International Arbitration Practice - Second Edition Preview Page I. This chapter focuses on a highly valuable procedure used in high stakes international arbitration proceedings to present fact and expert testimony to the arbitral tribunal. Much has been written about the struggle arbitrators and parties face in blending civil and common law traditions in international arbitrations. Your statement is the document that links all the evidence in your file of documents - the file is called a ‘bundle’. You can use headings - for example if you’re making more than one claim, you could have a heading for each. You should type your witness statement and number each paragraph. For example, Article 20.Originally from the ICDR Handbook on International Arbitration Practice - Second Edition If you’re writing your own witness statement. Indeed, arbitrators may decide, given the specific circumstances of the case, not to hear witnesses or all the witnesses a party wishes to examine (see "The Confirmation of the Witness Statement", page 70). It assists the arbitral tribunal to determine whether a specific witness testimony is relevant to the dispute (if it is not, the principle of efficiency would suggest that the witness should not be summoned to appear at the hearing), or whether it is sufficiently well-informed through other evidence and does not need to hear the witness. It assists the parties and the arbitral tribunal to prepare for the evidentiary hearing. It enables the parties to narrow the issues to be addressed at the evidentiary hearing. The advantages of this practice are the following: At trial, juries and magistrates do not receive the written witness statements of witnesses who are called to give evidence (except on rare occasions), so what the witness says will be their evidence in the trial. Then, in the course of the evidentiary hearings, the witnesses orally confirm their statement and may be cross-examined by the opposing party (and re-examined if the party which submitted the witness statement so wishes). This is known as their ‘evidence-in-chief’ and the questioning of the witness at this stage is the ‘examination-in-chief’. Usually, the parties submit witness statements with (or sometimes after) their memorials. In fact, the production of witness statements has become common practice in international arbitration. Consistent with the common law practice of affidavits and the practice of "déclarations de tiers" before some civil law courts, arbitration rules often provide that witness testimony may be contained in a statement in writing. In other words, you could ‘dial your ride.’ You could turn the dial on the top of the fork to vary the front suspension, with a choice of four different settings. In an era when bicycle designers were becoming increasingly adventurous with their front forks – a selling point that could make or break a bicycle – Huffman designers hit upon an ingenious reason for creating the largest fork. The Huffman Dial-Your-Ride bicycle sported a front fork that was bigger than any other bicycle on the road. But it’s on its way…Īfter six years, it’s taken the 2020 pandemic for me to get round to pulling the 26X out from the back of the workshop and adding a saddle, grips and pedals so it’s presentable for some photos. It’s taken a lot longer than anticipated, as both Baz and I were sidetracked by other jobs. I was short of a front wheel so I put on a ‘spring wheel’ that I was just about to fit to the 1905 Victoria used in WW1 I threw together various parts to see how they’d look. Below you can see the mudguards I found.Īs I find more parts and start to build up the Flocycle, I’ll add photos and details to this page. Here’s the frame after repair. Once I knew it was repairable, I started to assemble parts. By comparison, aluminium welding a Silver King headstock was not difficult. His company specialises in complex jobs, including aluminium welding. You can see part of his workshop below, where they are building aluminium bodies for exclusive cars, a Voisin and a Bugatti. When I require specialised work on my bicycles, I go to my friend Julian. However, as the forks are also damaged, it’s more likely that this damage has been caused by a front-end shunt.Īs the frame is aluminium, it’s not something we can weld in our workshops. I assumed that, being an aluminium frame, the head is more of a stress point than with a conventional frame. Here you can see the damage to the headstock. Throughout 2014, work progressed well, but then I found myself so busy with other projects that it got pushed to the back of the workshop …where it remained until April 2020!ġ939 Monark Silver King Flocycle 26X Custom The fork was bent and broken, and the headstock was badly damaged. I started with just the essential parts, the frame and sprocket. Hot rod and custom cars flourished in America before and after the war, so I decided to use them as my inspiration. It was an interim experimental model – interrupted by WW2 – which culminated in a completely different style of Silver King – the Hextube, also with 26″ wheels, introduced in 1946. While the first models had 24″ wheels, in 1939 they made the 26X, so called because it has 26″ wheels. After the initial Flocycles were launched in 1936, the company decided to develop the model further. The 26X is the rarest of the Silver King Flocycles. So I decided to design an interesting custom bicycle for personal use and, as a result, the remains of a Silver King Model 26X became my 2013 winter project. The problem when your hobby is also your business is that it can be hard to separate the two. I worked on so many vintage bicycles each year to put them back on the road in authentic original condition that I needed a diversion. …it’s now 2020, and it’s nearly finished!
